立院旁燒國旗 兩男遭起訴

蔡姓男子與李姓男子被控去年10月15日在立法院旁集會活動燒毀國旗，台北地方法院檢察署日前偵結，依污辱國旗罪嫌起訴。

檢方表示，蔡姓男子與李姓男子參加民主進步黨以「人民倒閣、總統下台」為由，向警方申准在台北巿濟南路舉行的集會活動。

檢方說，李姓男子在活動現場持中華民國旗，蔡姓男子則以打火機點火燒毀國旗。多家媒體拍攝畫面報導，成為鐵證。轄區警方主動偵辦後，全案移送北檢。

檢警偵辦期間，兩人坦承犯行，辯稱不滿總統馬英九國慶演說，才在活動現場燒國旗；北檢日前偵結，依侮辱國旗罪嫌起訴並向法院聲請簡易判決處刑。

中華民國刑法規定，意圖侮辱中華民國，而公然損壞、除去或污辱中華民國徽、國旗者，處1年以下有期徒刑、拘役或新台幣300元以下罰金。
