酒駕刑事優先　男子少付7500元

基隆市1名魏姓男子，3月間在家中喝了1小杯藥酒後，開車外出被警方攔查，酒測值達0.63毫克，男子解釋因罹患肝硬化及肝癌，肝臟無法代謝阿摩尼亞，才會酒精濃度超標，並非酒駕，監理單位並於4月15日裁決，罰款67,500 元，吊扣駕駛執照12個月，1年內不得再考領駕駛執照，並應參加道路交通安全講習；魏男觸犯公共危險罪，同時也收到基隆地院簡易判決有期徒刑2月，如易科罰金共6萬元；男子向法院提起行政訴訟，請求監理單位撤銷裁決，全案審結，基於刑事優先及一行為不二罰原則，判處65,000元罰款部份撤銷，其他吊扣駕照等處分，維持原判，可上訴。（蔡進男／基隆報導）
