勞基法適用鎖定編制外教師

勞動部今天指出，今年將與教育部溝通，釐清編制外的代課老師等教師的人數及工作內容，盼儘快納入勞基法保障範圍。

勞動部持續擴大「勞動基準法」適用範圍，近年包括法律服務業的律師、部分農民團體等都陸續納入勞基法保障範圍，剩下約40萬名勞工尚未適用勞基法。

勞動部今天指出，編制外從事教學工作的代課老師等教師，過去因課後還要輔導學生等，工作時間較難認定，因此尚未納入勞基法，今年將持續與教育部溝通，盼釐清人數、工作內容狀況等，儘快納入勞基法保障範圍。

此外，勞動部也提醒，未依「公寓大廈管理條例」規定成立或報備的大廈管委會員工，自元旦起已適用「勞動基準法」，其勞動契約、工資、工時、休息、休假、職業災害補償等勞動條件不得低於勞基法規定，雇主須替勞工加保就業保險，並提繳勞退新制退休金及提繳積欠工資墊償基金。
